Text Messaging Terms and Conditions

By opting in to receive text messages from ACKLEY FLORIDA PROPERTY MANAGEMENT, INC. (“Ackley Florida Property Management,” “AFPM,” “we,” “us,” or “our”), you agree to these Text Messaging Terms and Conditions (the “Agreement”).
These terms govern your participation in our text messaging service (the “Service”) and are intended to supplement, and not replace, any other terms, conditions, agreements, or privacy policies that may apply to your relationship with Ackley Florida Property Management.
1. Providing Telephone Numbers and Duty to Notify
You represent and warrant that any mobile telephone number you provide to Ackley Florida Property Management is true and accurate and that you are the current subscriber or authorized user of that telephone number.
You agree to notify us promptly if your telephone number changes, is disconnected, is transferred to another individual, or is no longer under your control.

2. Consent to Receive Automated Text Messages
By voluntarily providing your mobile telephone number and opting in to our Service, you expressly consent to receive recurring text messages from Ackley Florida Property Management, including SMS, MMS, or successor messaging technologies, using automated technology where applicable.
Messages may relate to your relationship with Ackley Florida Property Management and may include, but are not limited to:
- Property management communications
- Maintenance requests, updates, and coordination
- Property access and appointment reminders
- Showing and inspection reminders

The Service is primarily intended for transactional, informational, and service-related communications associated with property management, leasing, ownership, tenancy, maintenance, and related services.
Consent to receive text messages is not a condition of purchasing or obtaining any property management, leasing, rental, or other service from Ackley Florida Property Management.
Message frequency may vary depending on your relationship and interactions with Ackley Florida Property Management.

3. Opting Out of Text Messages
Your consent to receive text messages is voluntary, and you may withdraw your consent at any time.
To stop receiving text messages from Ackley Florida Property Management, reply STOP to any text message received from us.

After you submit an opt-out request, you may receive one final text message confirming that your request has been processed. After that confirmation, no additional text messages will be sent through the Service, except where permitted or required by law.
Please note that opting out of text messages may not prevent Ackley Florida Property Management from contacting you through other communication methods, including telephone, email, postal mail, or other lawful means when necessary to provide services, fulfill contractual obligations, respond to requests, or address property-related matters.

5. Privacy
Ackley Florida Property Management respects your privacy.

6. Third-Party Messaging Provider
Ackley Florida Property Management uses third-party telecommunications and messaging service providers, including Broadvoice, to facilitate certain telephone and text messaging services.
Broadvoice provides the underlying communications technology used to transmit certain messages on our behalf. Ackley Florida Property Management remains responsible for the content and purpose of messages that we send through the Service and for obtaining and maintaining any consents required by applicable law.
Broadvoice is not responsible for disputes, claims, or obligations arising from the relationship between Ackley Florida Property Management and its customers, residents, owners, applicants, vendors, or other recipients of our communications, except to the extent otherwise required by applicable law or an applicable agreement.
7. Participation Requirements
By participating in the Service, you represent that you are at least eighteen (18) years of age or are otherwise legally authorized to provide the consent required for participation.
You must have a wireless device capable of receiving and sending text messages and maintain service with a participating wireless carrier.
Not all wireless carriers or devices may support all messaging features. Message delivery may be affected by circumstances outside of Ackley Florida Property Management’s control, including wireless carrier availability, network limitations, device compatibility, or other technical conditions.
8. No Guarantee of Delivery
Ackley Florida Property Management does not guarantee that every text message will be successfully delivered.
Text messages may be delayed, blocked, filtered, or otherwise affected by wireless carriers, network conditions, technical limitations, or other circumstances outside our reasonable control.
9. Your Representations and Responsibilities
By participating in the Service, you represent and warrant that:
- The mobile telephone number you provide belongs to you or that you are authorized to use it;
- You have the authority to provide consent to receive messages at that number;
- The information you provide to Ackley Florida Property Management is accurate;
- You will promptly notify us if your telephone number changes; and
- You will not knowingly provide Ackley Florida Property Management with a telephone number belonging to another person without that person’s authorization.
10. Changes to These Terms
Ackley Florida Property Management reserves the right to modify these Text Messaging Terms and Conditions from time to time.
Any material changes may be communicated through our website, text messaging Service, or other appropriate communication methods.
Your continued participation in the Service after changes become effective constitutes acceptance of the revised terms, to the extent permitted by applicable law.
11. Severability
If any provision of these Terms and Conditions is determined to be invalid, unlawful, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
12. Applicable Law
These Terms and Conditions shall be interpreted and applied in accordance with applicable federal and Florida law.
Nothing in these Terms and Conditions is intended to waive or limit any rights or protections that cannot lawfully be waived or limited.
